I would have said "no not yet, we're not done yet," and then gauge her tone and attitude. Sorry, but "we just got here" would put me on the defensive no matter the tone.

Come to think of it, they didn’t “just get here.”  They didn’t even “just” start eating; they’d been served ten minutes before. 

I still agree the waitress jumped the gun.  But I can see how “we just got here” could put her off.

If she was still snide after you explained you just got here, I would put down my fork, ask for a manager, and when the manager arrived I would explain that we would NOT be paying for our meals, because apparently we weren't supposed to even eat in the restaurant, and we hadn't even eaten yet, and that I would be taking my business elsewhere, where it was actually wanted. Then I would get up and leave, and go somewhere else.

I think that's a bit extreme!

ETA: OP said the server "seemed offended", she didn't say the server was "snide" or had an attitude.

Sorry my bad the OP mentioned that she didnt speak snidely and that was where i picked it up. Point still stands. Waitress was offended, and if she (waitress) continued escalating her behavior the above is what i would do.

The OP perception was that she was offended. It could have been a look of being stunned by the response. I would assume the OP would have shared any verbal response given.

So are you saying that with the encounter that was shared you would just let it go and not do anything?

I agree with the OP that I'd feel a bit rushed too! But all these suggestions of refusing to pay (or tip), or calling for a manager seem a tad extreme to me. Provided the waitress otherwise provided decent service, I'd just chalk it up to a moment of obliviousness, or overzealousness, or what have you.

OP here.

To answer Lowspark’s question, this isn’t a restaurant that closes between lunch and dinner hours. It is open from 11am to 10pm so there was no need to hurry people out.

I’m glad I made the remark  but I wouldn’t have taken it any further. She got the customary tip. It’s not the kind of thing I would complain about it to management, unless it happened over and over again (in which case I’d probably stop going there anyway).

I enjoyed reading everyone’s responses and seeing what other people would have done.

I looked at my favorite local Mexican restaurant and the hours are 11:30-3pm, 4:30 - 10pm.

So if you came in at 2:55 and the waitresses shift ends at 3:00, she is going to want to take care of her part asap.

I truly can't imagine being bothered by that.  In light of everything that's happening nowadays, it doesn't seem like that big a deal.  Certainly not "Take me to your manager" worthy.

Of course there could.  But it's not on the customer to fix or accomodate.  Another waitress would/should take over.

As a former server even if you are closing, you don't just drop the check off right after your table gets the food.
 Yes, it is unfortunate if a table comes right before your shift ends, but it's the nature of the job. I have had people come in 5 minutes before closing, but you smile and treat them like any other customer.

Many years ago, my husband regularly worked at a client about 3 hours away. I was a SAHM, so my toddler and I would come with him, and explore the area. It was a small town with limited dining options, but there was a little diner with en extensive dessert menu. The waitress would always bring our check with our meal, then act put out when she had to rerun the bill after we ordered dessert. We had to resort to telling them, “we will probably order dessert when we’re done, so please don’t bring us the check!”

I hate feeling rushed or pressured, and there were times we skipped dessert just because we didn’t feel like bothering the waitress any more. It wouldn’t rise to a “speak to the manager” level, but it did leave me less than impressed, and likely to go elsewhere in the future.
